Are we liable for leakages in neigbhours flat???????

I stay in a 7 storey building in Navi Mum Maharashtra India. I am on the 6th Floor. Over a period fo last few weeks there has been a constant seepage into my house from the house above (7th Floor flat), On checking it was confirmed that the leakage is from the washroom of the above flat. I asked him to get it rectified but he is insisting that I foot in the half of that expense. I want to know if under any society by-laws, am i a liable to pay for work to be done in his house???.
